Company Policies
DandyNet, the Internet division of Dandy Connections, Inc., is dedicated to providing individuals and organizations with effective and affordable Internet access. In order to maintain a high standard of service that meets the needs of all Dandy's customers and to avoid problems that often result from disseminating information that is either harmful, false, malicious, or violates the rights of others, we find it necessary to establish the following terms and conditions. Please note that Use of any of DandyNet services constitutes acceptance of these terms and conditions by Customer.
  1. Network Access and Usage. DandyNet offers unlimited internet access, but it is not a full time 24 hour connection. Connections are subject to termination after 20 minutes of inactivity and as a DandyNet customer, you agree not to use any automatic method (software, techniques, devices, or any other method) to avoid a disconnection. This policy is in place so that DandyNet may continue to offer a 5:1 port to user ratio, which is much more generous than any other main ISP. Customers improperly maintaining 24 hour connections occupy ports unnecessarily and make them unavailable to other users trying to get online.

  2. Dial-up Accounts. Accounts are to be used only by the Customer, the Customer's immediate family, or employees of the Customer (for Business accounts) and are non-transferable. Customer certifies to DandyNet that he or she is at least 18 years of age. If Customer is a parent or legal guardian of a minor, he or she may permit that minor to use his or her account under supervision. Customer agrees that he or she shall be fully responsible for the conduct of such minor in using DandyNet services, and Customer shall be liable for any misuse by such minor for violations of this agreement.

  3. Email Practices and Limits. Email boxes are limited to 20MB of disk space and thirty (30) days storage time. Messages older than thirty (30) days will (either automatically or at Dandy's discretion) be deleted on day thirty one (31) and any or all messages are subject to deletion when the 20MB limit is exceeded. Email accounts which have not been accessed in six (6) months are subject to inactivation or deletion at Dandy's discretion. Customers are not to leave Email on Dandy's Mail Server as a permanent storage solution.

    Please review Dandy's Company Policies regularly since Dandy may from time to time revise its practices and limits concerning your email account or other policies. You agree that Dandy is not responsible for any email or attachments that are blocked or deleted for any reason and that you have no right, and Dandy has no obligation, to retrieve or access any such deleted or blocked email or attachments. You agree that Dandy is not responsible for any email or attachments that it fails to block or delete, even if such email or attachments contain viruses or are otherwise harmful to your computer.

  4. Service Usage. Multilinking Prohibited. The use of more than one login session at any time by the Customer on any system account constitutes multilinking, which is prohibited. A Customer's monthly fee shall be doubled when multilinking has occurred on the customer's account and DandyNet reserves the right to terminate without refund or further notice any such account. If the Customer has multiple accounts, the Customer is limited to one login account per system account at any time; user programs may be run only during login sessions.

  5. DandyNet Roaming Fee. Internet access numbers appear in the "Coverage Areas" pages of DandyNet's website; a group letter is assigned to various US Cities. For example, Atlantic City, NJ, is in "Group A". Subject to all other Company Policies provisions, to use any access number other than those assigned to the group designated for the city and state listed as your address in your DandyNet account, you will be required to first obtain written permission from DandyNet and you will be charged an additional monthly $8.00 DandyNet Roaming Fee.

  6. Compliance. It is strictly prohibited for the Customer to use such conduct in Dandy's sole discretion that will restrict or inhibit any other DandyNet or other system user from using and enjoying any of DandyNet's services. This includes, but is not limited to, the posting or transmitting on or through any of DandyNet services, any information that is, in DandyNet's sole discretion, unlawful, obscene, threatening, abusive, libelous, harmful, or encourages conduct that would constitute a criminal offense, give rise to civil liability, or otherwise violate any local, state, national, or international law.

  7. Data Transmission. Customer expressly agrees to use all of DandyNet services only for lawful purposes. Transmission or storage of any information, data, or material in violation of the United States, or state regulation or law is prohibited, including but not limited to, material protected by copyright, trademark, trade secret, or any other statute.

  8. Limitation of Liability. DandyNet will not be liable under any circumstances for any lost profits or other consequential damages, even if the company has been advised as to the possibility of such damages. DandyNet's liability for damages to Customer for any cause whatsoever, regardless of the form of action, and whether in contract or in tort, including negligence, shall be limited to one (1) month's fees and the remaining portion of any prepaid fees. This clause includes any and all charges, telephone and other, that may result from using an incorrect local access number, whether obtained through any DandyNet employee, printed material, or website reference. DandyNet will not be responsible for any telephone charges incurred through the use of its service. The customer has the right and obligation to verify the existence or absence of toll charges on any access number prior to use of that access number.

  9. Suspension of Accounts. DandyNet reserves the right to suspend or restrict access at any time to any account which in DandyNet's sole discretion violates any of the terms of this agreement or fails to make full payment in a timely manner. Accounts which are past due 20 days may be subject to immediate suspension.

    Scheduled services such as Website Updates and Networking service calls may be denied for accounts which have been suspended for any reason. Data, including e-mail messages and website or other files, may be refused by DandyNet's servers or removed at DandyNet's sole discretion while an account is under suspension. Services may or may not be restored at DandyNet's discretion upon payment in full or removal or cessation of the violating behavior which caused the suspension.

    Notwithstanding any other provision in this document, when an account is suspended or terminated by DandyNet, NO refund will be issued for any service, goods or unused time.

  10. Indemnification. Customer agrees to indemnify and hold DandyNet harmless against any lawsuits, claims, damages or liabilities (or actions or proceedings in respect thereof) to which DandyNet may become subject to, or that arise out of Customer's use of DandyNet's services, and will reimburse DandyNet for all and other expenses, including attorney's fees and any other fees incurred in connection with investigating, defending, or settling any such loss, claim, damage, liability, action, or proceeding whether or not in connection with pending or threatening litigation in which DandyNet is a party. Customer shall reimburse DandyNet for all collection expenses including but not limited to the following: $20.00 for a returned check, $35.00 for a returned e-check and $2.00 for a declined credit card. The provisions of this agreement relating to indemnification shall survive the termination of the customer's account.

  11. Termination by Customer. During the first three (3) days of service, a Customer may terminate service by written notice sent by electronic mail to cancel@dandy.net, by fax to 609-345-5200, or by U.S. Mail to Dandy Connections, Inc. 1332 Atlantic Ave., Atlantic City, NJ 08401

    Beyond the first three days of service, thirty (30) days written notice will be required for account termination, sent by electronic mail to cancel@dandy.net, by fax to 609-345-5200, or by U.S. Mail to Dandy Connections, Inc. 1332 Atlantic Ave., Atlantic City, NJ 08401.

    DandyNet may in certain circumstances and at its sole discretion waive part or all of the 30 day notice period for an active customer whose account is currently paid and who has had service for more than one month (1 month), and whose written cancellation request is received by DandyNet by the 10th of the month which the customer had requested to be the final month of service.  Only the DandyNet Billing Department will grant a waiver and otherwise process terminations. Cancellation requests submitted by any party other than the actual account holder cannot be accepted.

CANCELLATION REQUESTS ARE NOT ACCEPTED VIA PHONE.

A customer account may have more than one service, such as dialup, e-mail, website hosting, etc. A cancellation request shall be considered to be a downgrade request so long as the customer account will have at least one billable service active upon completion of the request. Requests to downgrade an account will be processed and completed as of the end of the current billing cycle.

  • Acceptance of Terms. Use of any of DandyNet services constitutes acceptance of these terms and conditions by Customer.

  • System Abuse. The following actions are defined as "system abuse" and are strictly prohibited. Accounts which show activity described by any of the following are subject to immediate and unannounced suspension and/or termination. This list in non-exclusive, and is provided solely for guidance to DandyNet Customers. DandyNet reserves the absolute right to terminate any account found to be in violation of this document. DandyNet further reserves the right to determine what constitutes a violation and take appropriate action against the account holder in the case of said violation. This decision is final and without appeal.

    • Attempting to create an "active" full time connection by using artificial means with software, programming, or any other method.

    • Attempting to circumvent user authentication or security of any host, network, or account ("cracking").

    • Attempting to interfere with or deny service to any user or any host.

    • Using any program/script/command, or sending messages of any kind designed to interfere with a user's terminal session, via any means, locally or by the Internet.

    • Attempting to circumvent the 30 minute inactivity rule by any method.

    • Furnishing false data on the sign-up form or via online application, including fraudulent use of credit card numbers.

    • Reselling DandyNet accounts or services unless specifically permitted under a separate written agreement.

    • Sending bulk, unsolicited, email (commonly know as "spam"), either from a DandyNet dial up or dedicated account or any other account into the Internet or any network connected to the Internet is prohibited. It is further prohibited to use, or in any way make available, any of DandyNet's Email, WEB, NEWS or ANY OTHER server for the purposes of "relaying" unsolicited Email or USENET articles. Any account or customer (personal or commercial) violating DandyNet's anti-spam policy will, among other things, be billed at the rate of up to $200.00 per hour for any work incurred by our support, help-desk, system administration or legal personnel as a result of this activity. There will be no exceptions, and it is our policy in such instances to employ aggressive collection procedures, including litigation if required.

    • Transmitting or posting "chain letters" (multiple forwarding) of any type.

    • Transmitting or posting of any file which contains viruses or any other contaminating or debilitating features.

    • Using the facilities and capabilities of DandyNet or its services to conduct any illegal activity or other activity which infringes the rights of others.  

  • Refund Policy - DandyNet is an ISP offering Internet service as well as sale of some computer components (merchandise). Claims for replacement or refund of damaged, defective, or unwanted merchandise must be initiated within 14 days of purchase. To initiate a claim, please an e-mail to support@dandy.net or call us at 800-636-1188. Please include all pertinent information, including the description of merchandise, description of problem, transaction information, etc.

  • Damaged or Defective Merchandise - DandyNet will replace or refund the purchase price of factory defective merchandise. The option to replace or refund is at DandyNet's sole discretion. Merchandise damaged by the user through misuse or negligence will not be replaced or refunded. Replacements or refunds for merchandise damaged in shipping will be subject to a claim filed by DandyNet with the shipping carrier. Freight/shipping charges and service charges are not refundable in any case.

  • Non-Defective Merchandise - Merchandise in good working order and saleable condition may be returned to DandyNet for any reason within the first 14 days of purchase. There will be a 20% restocking fee for non-defective merchandise returned. Freight/shipping charges and service charges are not refundable in any case.

  • Prepaid Internet Service Fees - When a prepaid internet account is terminated by a customer, DandyNet will pro-rate a refund of the prepaid service term from the effective cancellation date after the required 30 days' written notice is given (see paragraph 10). The service time used (including that of the 30 day notice period) is subtracted from the prepaid amount and the difference is refunded to the customer after the effective date of cancellation. The service time used is billed at the regular service rate, because any discounted rate offered to prepaid accounts is only available for customers who keep the prepaid service for the entire term. Notwithstanding any other provision in this document, when an account is suspended or terminated by DandyNet, NO refund will be issued for any service, goods or unused time.

  • DSL Service Deposit and Fees - Prior to processing an order for Residential DSL Service, DandyNet must receive a non-refundable $50.00 installation fee as well as a non-refundable payment of the first three full months' service fee.

    DandyNet's DSL Service is subject to a one (1) year agreement. Customers refusing delivery of the DSL Service or terminating the DSL Service before the end of the one year agreement will be subject to a $100.00 early termination/service fee. Month-to-month DSL Service is available under prior arrangement with DandyNet and only with the payment of a $100.00 installation fee prior to or at the time of placing the DSL Service order.



  • Domain Registration - DandyNet provides domain registration through OpenSRS, which is a division of Tucows. DandyNet will register customers' domain names in customers' own name. Customer is responsible for timely renewal of domain names to avoid loss of domain name or additional fees due to domain expiration. DandyNet accepts no liability for loss of business, revenue, or downtime associated with domain name expiration. All domain name customers agree to be bound by the OpenSRS/Tucows agreement labelled 'Domain Agreement', which can be read in its entirety at http://www.dandy.net/domainregagreement.html. All domain name customers also agree to be bound by the policies of the Internet Corporation for Assigned Names and Numbers (ICANN), which can be read in its entirety at http://www.dandy.net/icannpolicy.html. Domain registration customers are required to read both of these documents prior to applying for domain registration with DandyNet. Placing a domain registration order with DandyNet indicates that you have read, understand, and agree to adhere to these policies.

DandyNet values your privacy. We want to make your experience on the Internet as enjoyable and rewarding as possible, and we want you to be able to confidently utilize use all the information, tools, and opportunities the Internet has to offer.

DandyNet has created this Privacy Policy to demonstrate our commitment to your privacy and security. This Privacy Policy describes how DandyNet collects information from users of DandyNet’s Internet services (the “Services”), how we use the information collected, and the choices you have concerning the collection and use of such information. Please read this Privacy Policy carefully.

Collection and Use of Information

Members are asked to provide certain information when they sign up for our Services such as name, address, telephone number, billing information (such as a credit card number, birth date and/or social security number) and the type of personal computer being used to access the Services. The personal information collected from Members during the signup process is used to manage each Member’s account (such as billing and collections).

DandyNet does not share personal information collected during the signup process or during any part of the members’ term of service with DandyNet. No DandyNet staff member is permitted to use any information provided in serving our members for any purpose other than providing DandyNet service. No personal member data, including e-mail addresses, is sold, rented, or given to any other company. In instances where DandyNet and an affiliate jointly promote DandyNet Internet services, DandyNet may provide the affiliate certain personal information, as a result of the joint promotion. In this instance, the information may not be used by the affiliate for any other purpose.

DandyNet uses information provided at signup to contact our members in a variety of ways. DandyNet may send members offers through e-mail, phone or regular mail for DandyNet products and services or offers on behalf of selected affiliates. If you order products or services directly from DandyNet, we will use your information to continue to provide you products or services in which you may be interested. Members may notify us of their choice not to receive any marketing solicitations from DandyNet by e-mailing support@dandy.net with a request to be removed from the marketing list. Members will still receive administrative and billing calls and/or e-mails from DandyNet as needed.

Online Shopping

At some web sites, you can purchase products and services or register to receive materials, such as a catalog or new product and service updates. In many cases, you may be asked to provide contact information, such as your name, address, email address, phone number, and credit/debit card information. DandyNet has no control over third-party web sites, whether or not they are hosted with DandyNet, and their use of any personal information you provide when placing such an order. Please exercise care when using online shopping websites.

Special Cases

It is DandyNet’s policy not to use or share the personal information in ways unrelated to the ones described above without also providing an opportunity to opt out or otherwise prohibit such unrelated uses. However, DandyNet may disclose personal information or information regarding use of the Services if, for any reason, in our sole discretion, we believe that it is reasonable to do so, including: to satisfy laws, regulations or other legal requests for such information; to disclose information that is necessary to identify, contact or bring legal action against someone who may be violating our Acceptable Use Policy or other policies; to operate the Services properly; or to protect DandyNet, our Services, our employees or our Members.

"Cookies" and How DandyNet Uses Them

A “cookie” is a small data file that can be placed on your hard drive when you visit certain Web sites. DandyNet does not use cookies at this time, though we reserve the right to use cookies in the future to collect, store, and track information for statistical purposes to operate and improve the products and services we provide and to manage our network and property. Please be advised that if you visit non-DandyNet web sites where you are prompted to log in or that are customizable, you may be required to accept cookies.

We do not control use of cookies on any third party website, regardless of whether it is hosted by DandyNet, and expressly disclaim responsibility for information collected through them.

Online Child Safety

Protecting children’s privacy is especially valuable to us. It is our policy to comply with the Children’s Online Privacy Protection Act of 1998 and other applicable laws. You must be 18 to open an Internet account with DandyNet. DandyNet does not knowingly attempt to collect information from any person under the age of 18.

DandyNet recommends that children ask a parent for permission before sending any personal information anywhere using the Internet.

Data Security

DandyNet has security measures in place to protect the loss, misuse, and alteration of the information under our control. While we make every effort to ensure the integrity and security of our network and systems, we cannot guarantee that our security measures will prevent third-party “hackers” from illegally obtaining this information.
